Perdarahan pervaginam dalam perspektif medis dan fikih: studi tentang pendapat pakar medis sebagai bentuk perumusan hukum tentang haid, nifas dan istihadah

The title of this research is “Vaginal Bleeding in the Medical and Jurisprudence Perspectives (Studies on Medical Expert Opinion as Legal Form Formulation of Menstruation, Puerpureum and Istihadah)”. This study based on some views of the legal jurist about vaginal bleeding which is less not in accordance with medical development. This study is conducted to answer the question: How is the formulation model of vaginal bleeding jurisprudence through medical approuch? This research is qualitative. Data were obtained through written sources, such as books and journals. The data were collected, described, and analyzed using inductive and deductive patterns. This research concluds, that the construction of “vaginal bleeding jurisprudence” has been deconstructed by a medical perspective. Therefore it is urgent to reconstruct “vaginal bleeding jurisprudence” by using the empirical- normative approach, redefining haid, puerpureum, and istihadah, reinterpreting the legal arguments of vaginal bleeding, and inviting medical expert as partners in the determining the sort of vaginal bleeding. This study has found a theory of “jurisprudence of reproductive system”, which has implications for the law of dysfunctional uterine bleeding, namely “istihadah” that is regarded as haid.
