KEWAJIBAN NAFKAH BAGI AYAH MELALUI WASIYAH WAJIBAH TERHADAP ANAK HASIL NIKAH SIRRI DAN ANAK ZINA : ANALISIS SURAT EDARAN MAHKAMAH AGUNG NO.07/2012 PERSPEKTIF TEORI KEADILAN ISLAM

This study is a library research entitled "Liability Living For the father with Wasiyah Wajibah to Child Marriages results Sirri And Child Adultery (Analysis of Mahkamah Agung Circular No.07/2012 perspective of Islamic justice theory)". From the title, the problem can be formulated as follows: 1) how the phenomenon of child marriage results Sirri and child adultery in Indonesia?, 2) How does Mahkamah Agung Circular No. 07/2012 in the perspective of Islamic justice theory?, and 3) How does a living liability for the father to Child Marriages results Sirri And Child Adultery with Wasiyah Wajibah by Mahkamah Agung Circular No. 07/2012?. This study will use secondary data obtained from various readings, good books, journals and other literature sources. Then, the data was analyzed by content analysis. From the research that has been done can be concluded that the Child Marriages results Sirri And Child Adultery can not sue the father of each of the rights, because it is not registered at the Registrar of Marriage employee, then by law. Mahkamah Agung Circular No. 07/2012, if viewed through the theory of Islamic justice is a long-term solution for the life of the Child Marriages results Sirri And Child Adultery for his future, to guarantee a living necessities of life, such as education, health, and others. This can be done Wasiyah Wajibah, whose number is based on a court decision.
