Hifdh al-Bīʻah sebagai bagian dari Maqāṣid al-Sharī’ah: pandangan Yusuf Al-Qardhawi dalam Kitab Ri’āyat al-Bīʻah fi Sharī’ah al-Islām

This thesis is a product of the academic restlessness the author had pertaining the reality wherein Indonesia, a country with Islam as the major religion most people put faith in, still has a continuous problem of environmental destruction. It doesn’t align with Islamic teachings, especially knowing that Islam is a religion that pays most attention to the environment. Yūsuf Al-Qarḍāwy through his book Ri’āyat al-Bīʻah fi Sharī’ah al-Islām affirmed that Islam is an eco-friendly religion, using maqāṣid al-sharī’ah as the method of approach. There are three main problems discussed in this work. Firstly, what was Yūsuf al-Qardhawy’s view on environmental ethics in Ri’āyat al-Bīʻah fi Sharī’ah al-Islām. Secondly, how was Yūsuf al-Qardhawy’s view on hifdh al-bī’ah as a part of maqāṣid al-sharīʻah. Thirdly, how was Yūsuf al-Qardhawy’s istiqra’I manhaj in establishing hifdh al-bīʻah as a part of maqāṣid al-sharīʻah. This research fell under the subject of normative law, and thus categorized as library research based on the method used in gathering the data. The primary and secondary data were analysed using the descriptive-analytic method. There are three findings highlighted in this work. Firstly, there are five basic principles of environmental ethics defined by Yūsuf al-Qarḍāwy: the principle of respect towards nature, the principle of responsibility, the principle of love and affection, the principle of simplicity, and the principle of justice. Secondly, Yūsuf al-Qardhawy’s concept of hifdh al-bī’ah is a medium to actualize kulliyāt al-khams. Thirdly, the istiqra’i manhaj in the defining of hifdh al-bī’ah as a part of maqāṣid al-sharīʻah is by finding juz’iy propositions to then be connected or associated to the values of maqāṣid al-sharīʻah, which is kully.
