PERILAKU EKONOMI WARGA NU KABUPATEN PASURUAN DALAM PERSPEKTIF HUKUM ISLAM : STUDI PENERAPAN PUTUSAN BAHTHUL MASĀIL

This study is aimed to answer two main problems; first, hat are the products of bahthul masail in economy? Second, do those products become conceptual principles of economy for Nahdlatul Ulama community in Kab. Pasuruan?
This study applies qualitative method by using phenomenological approach. This study did not consider normative sources (al-Qurán and Hadith) textually, but
using them as the agent of social change and social control in relation with social life.
The theoretical framework of this study is sociological approach toward law. Then, because the objects of law discussed are bahthul masail products of economy, so this
study employ Maqasid al Shari’ah, al Maslahah, ‘Urf, social reality, and its effects toward Islamic law and Islam Mua’malah principles as well.
Research findings in this study are 1. NU bah}thul masa>il since 1926–1999 has produced 439 verdicts divided into 20 kinds of resolution, one of them is in economical fields that dominate with 70 verdicts (15,9%). During the process, it can be explained that economical hitches discussed in bah}thul masail are actual problems happened in community. Those problems weren’t born in empty situations but triggered by some factors in community as social, politics, and economy. To overcome economical problems, references employed are Syafi’iyah books. 2. Pasuruan NU civilian who are highly obedient to the Ulama’ in their economical life,
didn’t fully employ bah}thul masail decisions as conceptual principles in their economy life. Their reasons using traditional law such economical transaction has become common, and they considered it as win-win solution for every party in the economy. In brief, NU civilian in Pasuruan behave in these three items; first, there are
some NU civilian that strictly obey bahthul masail. Second, there are some NU civilian that employ only half of bahthul masail products. Third, there are some NU
civilian that don’t follow bahthul masail decisions.
